Electronic cigarettes will be regulated as tobacco

Recently the U.S. Food and Drug Administration said that electronic cigarettes would be regulated as tobacco products. The announcement came after a decision by the D.C. Circuit Court of Appeals ruling that electronic cigarettes are not drugs or devices unless marketed for therapeutic purposes. In 2009, the FDA was authorized to regulate tobacco products which are not drugs or devices.

Electronic cigarettes are marketed with names such as NJOY and replicate the process of smoking. They include nicotine, but do not produce ash or odor. The FDA said that laboratory analysis had shown the presence in electronic cigarettes of carcinogens and toxins such as diethylene glycol, which is used in antifreeze.

The same day, The Campaign for Tobacco-Free Kids said it was disappointed with the appeal court ruling, saying it was a flaw that allowed manufacturers to add nicotine to products and bypass the regulations normally applicable to smoking cessation aids or other non-tobacco products which contain nicotine.

Electronic cigarettes were invented by the Chinese pharmacist Hon Lik in 2003. China remains the principal manufacturer.
